California’s Employment Laws Exist To
Protect You
California has strict labor laws in place to protect workers. Under California law, nonexempt workers must be paid overtime for the following:
- One and a half times the regular rate of pay for any hours worked in excess of eight per day or 40 in a week
- On the seventh consecutive day of work, workers must be paid one and a half times the regular rate of pay for the entire eight-hour workday
- Two times the regular rate of pay for hours worked in excess of 12 per day and all hours over eight on the seventh consecutive day of work
Some employers promote employees to managerial positions so they can avoid paying overtime. If you are a manager, but spend half your day doing the same tasks as your subordinates, you are not an exempt employee and are entitled to overtime.
