To Address Overtime Disputes
Many employees feel as if they are at the mercy of their employers. If they speak up about illegal practices — such as denied overtime — or voice other complaints, their job will be on the line.
The bottom line is this: You are entitled to overtime. Not paying you overtime for the extra hours you put in is illegal. At English Lloyd & Armenta, we will help you enforce your rights. Located in Rancho Mirage, we serve workers throughout the Coachella Valley.
California’s Employment Laws Exist To
California has strict labor laws in place to protect workers. Under California law, nonexempt workers must be paid overtime for the following:
- One and a half times the regular rate of pay for any hours worked in excess of eight per day or 40 in a week
- On the seventh consecutive day of work, workers must be paid one and a half times the regular rate of pay for the entire eight-hour workday
- Two times the regular rate of pay for hours worked in excess of 12 per day and all hours over eight on the seventh consecutive day of work
Some employers promote employees to managerial positions so they can avoid paying overtime. If you are a manager, but spend half your day doing the same tasks as your subordinates, you are not an exempt employee and are entitled to overtime.
Unpaid Overtime Pay
Going up against a large company can be intimidating. Many people feel too small to make a difference. At English Lloyd & Armenta, we believe every voice counts. By speaking up and forcing your employer to change its illegal practices, you are benefiting all of your fellow workers.
After bringing a wage and hour claim, many people are thanked by co-workers who also received checks from their employer for back overtime wages.
