Steps To Take After A Workplace Injury
Below is a general guide explaining the actions you should take after being injured on the job. However, it is always best to meet with an attorney upfront to ensure your rights are protected.
Report Your Injury
To A Supervisor
After a job injury, tell your supervisor right away. He or she will help you start the formal workers’ compensation process. If you don’t tell him or her, you may risk losing your right to benefits.
Take Note Of Witnesses
If other workers saw the accident, get their names and contact information. They may be able to act as witnesses for you later down the road.
Fill Out A Claim Form
To request workers’ compensation benefits, you must complete a claim form and submit it to your employer.
Get It In Writing
If your employer is not cooperating, make sure to document your injury in writing — either by emailing your employer, complaining of the injury to a doctor, or by writing a letter, email or text to your supervisor explaining how you got hurt.

After you file a claim, you will be contacted by your employer’s insurance carrier. It will send you to a doctor for an evaluation. After the first visit, you can select any doctor you want — as long as he or she is in the insurer’s medical provider network (MPN). Make sure you choose a doctor you trust, one who will listen to you and take your injuries seriously. Your medical benefits and lost wage benefits depend on it.
Insurance companies will often move slowly — they do this purposefully. Workers’ comp temporary disability benefits typically only last for 104 weeks, the slower the insurance company moves, the faster it eats up that benefit, and as a direct result, you will have less flexibility later to make important decisions.
